A bill to register births of unregistered foreign children is proposed again.  In the past, this kind of bill has been proposed several times, but this time, the possibility of actual legislation is high. This is because the government announced that it would enact a related law at the Social Relations Ministerial Meeting in November last year, and it is known that the government intervened in the process of introducing the law this time by assemblywoman Kwon In-suk.

Assemblywoman Kwon In-suk of the Democratic Party of Korea plans to introduce the “Foreign Child Birth Registration Act” in early June. This bill allows unregistered foreigners to apply for birth registration of their children at the competent city, gun, and district rather than at the immigration office. The official in charge does not need to notify the immigration office of the fact of parents’ illegal residency, so that the child's birth registration does not lead to a parent's accusation of it.

According to this bill, the Ministry of Justice maintains the birth register for foreign children under the age of 19 who were born in Korea and issues a birth certificate stating that they were born in Korea when the foreign child or his or her immediate blood relatives wish to verify it.

The background to the promotion of the Foreign Child Birth Registration Act is the UN Convention on the Rights of the Child, which Korea ratified in 1991. The convention states that children must be registered immediately after birth.

If this bill is passed by the National Assembly, it is expected that foreign children with unregistered parents will be able to receive medical and education benefits in Korea.

Assemblywoman Kwon In-sook said, "The registration of a child's birth is a starting point to be recognized as a public entity and to enjoy legally guaranteed rights such as medical care and education."

Currently, it is estimated that the number of unregistered foreign children will exceed 20,000.
