I am a foreign worker and I ride a motorcycle. Recently, while driving a motorcycle, I collided with a car coming from the opposite direction. I didn't do anything wrong and it's the car's fault. However, an employee of the insurance company of the offender saw my motorcycle and said that the vehicle was not registered and that I had to call the police. What can I do in this case?

In Korea, all motorcycles must be registered with the local government, issued a license plate, and attached to the motorcycle before driving. You should also have insurance in case of an accident.

Both of these things are mandatory and you will be fined if you didn’t. The fine for negligence for not registering a motorcycle is 500,000 won, and a fine of 300,000 won or more for non-insurance is imposed. Particularly, if an accident occurs without insurance, the fine can increase to less than 5 million won.

If accidents doesn't happen normally, you're lucky, but if it does, you'll be subject to enforcement for violating these two obligations.

Therefore, in the case of the questioner, even if there is no fault for you in the traffic accident, you may be enforced by being reported by the insurance company.

Another thing, the questioner said that he or she was not responsible for the traffic accident, but the fault of the questioner can come out, even in a very small part. For example, even if the fault of the offending vehicle is 95% and the questioner is 5%, he or she is still responsible for paying 5% of the amount of damage.

However, the problem arises because it is not insured.

In Korea, under no circumstances should you drive an uninsured, unregistered motorcycle. You probably know that you must also obtain a driver's license as well, right?
