My friend is illegally present. But six months ago, he or she got hurt while working. He/she had to report it as an industrial accident, but he/she did not report it because he/she was staying illegally, and he/she made an agreement with the employer to just receive medical expenses, etc. However, after a few days, the employer is still not paying medical expenses. Now my friend is going to report it to an agency like the Labor Office. But when my friend talked to the employer, he or she threatened not to say it because there will be disadvantages such as forced deportation. Is there really such a risk?

Even illegal immigrants can receive all compensation if they suffer an industrial accident in Korea. Even if you report an industrial accident while staying illegally, the Korea Workers' Compensation and Welfare Service does not report the worker to the Ministry of Justice.

However, in such cases, the employer, the boss, may report the worker to the Ministry of Justice. Even so, the Ministry of Justice does not forcibly take workers who have suffered industrial accidents to foreigner shelters, etc. This is because treatment and compensation for industrial accidents are prioritized.

The Ministry of Justice may send a 'departure order' document to worker who have suffered an industrial accident when it is determined that the treatment for industrial accidents is over.

Please do not be deceived by the employer and be sure to report an industrial accident to receive compensation.
